MSHA Compliance Requirements

Step 1:  Download Required Documents

MSHA requires that mines and mining professionals retain printed training plans and records of training.  Click the links below to download the required documents:

Step 2: Complete Training Plan

Now that you have downloaded the compliance documents, fill out the Training Cover Sheet - Tab 1 of your Training Template. 

Fill it out completely with accurate information, including:  MSHA ID number, trainers, topics to be covered, estimated training times, training methods, and evaluation procedures.   

Step 3: Complete All Required Training 

MSHA requires the following training in addition to the training we provide:

  • New Miner
    • Mine tour,
    • Review of site-specific hazards,
    • Any other necessary in-person task training.
  • Annual Refresher 
    • Training on “changes at the mine”.

Complete all the training in compliance with MSHA's requirements. 

Step 4: Complete Records of Training 

To officially record that training has been completed, fill out the Record of Training - Tab 3 of your Training Template and the MSHA Form 5000-23 Certificate of Training.

Once complete, print the Record of Training & MSHA Form 5000-23 Certificate of Training to be signed by a supervisor, manager, or individual responsible for health and safety in the organization and keep on record.

1) Where can I buy a product that provides all 24 hours of MSHA Part 46 requirements for New Miner training?

To be compliant with MSHA training requirements, you'll still need a tour of the mine and site-specific hazard training. A mine tour and instruction on the recognition and avoidance of hazards present at the mine are required by MSHA. If you're a mine contractor, this means you should coordinate with the surface mines you'll work with for mine-specific information, tours, and any other necessary training related to hazards in the area of the mine where you'll work.

2) What if I am only on a mine site for limited time and always supervised? Do I need compliant training?

MSHA requires training for any person doing work, maintenance, or anything on a mine site for an extended period of time or on a frequent basis (more than five consecutive days or five days out of the year). Also, all mines have the right to require training even if MSHA doesn't.

The Mine Safety and Health Administration, MSHA, is a federal organization within the United States Department of Labor that provides governmental oversight of the country's mining industry.

4) What is MSHA Part 46?

MSHA Part 46 is a section of Title 30 Code of Federal Regulations, 30 CFR, which defines health and safety rules and compliance requirements for non–metal and non–coal surface mines.

Mines that produce coal, metals, and other commodities through underground operations are governed by MSHA's Part 48 regulations with significantly more rigid training and documentation requirements.

5) What do I need to be compliant with MSHA Part 46?

You need paperwork that shows you've planned, executed, and documented the training MSHA requires. For specific personnel, it must meet the minimum time requirements within the specified time periods.

MSHA Part 46 requires New Miners to be provided with no less than 24 hours of training no later than 90 days after starting work at the mine. But don't let that scare you. Only 4 hours of that training needs to take place BEFORE beginning work at the mine.

It's also critical for everyone to understand that miners and mine contractors are required to have all the same training. This includes Annual Refresher training which MSHA outlines in two pieces:

  • Instruction on changes at the mine that could adversely affect miners' health or safety; and
  • Other health and safety subjects relevant to mining operations at the mine.

So once you've covered Changes at the Mine with your team, you can use any of our training courses to address other health and safety subjects relevant to your team's work at the mine.

10) What if I need training for multiple job sites or have a large number of employees?

11) I'm a contractor. Do I need to have a training plan?

Yes! MSHA requires any person, partnership, corporation, subsidiary of a corporation, firm, association, or other organization that contracts to perform services at a shell dredging, sand, gravel, surface stone, surface clay, colloidal phosphate, or surface limestone mine, to meet training requirements and provide all the associated documentation.

If you are considered a miner, you must have a written training plan, printed records of training, and continue to remain compliant with eight hours of Annual Refresher Training
