This 1-hour interactive online course provides a brief overview to teach the construction professional the definitions of the basic concepts of the mediation process. Mediation is rapidly becoming a preferred method to resolve disputes arising from the construction process, both during and after contract performance. If you are a prime contractor, subcontractor, architect, engineer, construction manager, owner''s representative, surety, insurance company, or otherwise involved in construction, it is highly likely that you will be a party to one or more mediations during your career. This course will provide basic information to the construction professional to allow him or her to understand the mediation process.

There will be a brief multiple-choice quiz at the end of each scenario.

Course Objectives

After completion of the course, you will:

  • Understand the difference between mediation and other techniques of dispute resolution
  • Understand the basic principles of mediation and how it is used to resolve disputes
  • Understand the stages of mediation and what happens in each stage
  • Have a basic vocabulary of terms used in mediation

Allan Goodman, J.D. Photo
Allan H. Goodman is a Judge on the United States Civilian Board of Contract Appeals, where he adjudicates claims between private contractors and the federal government. From 1975 to 1993, Judge Goodman was an attorney in private practice. His practice emphasized construction law, surety law, and government contract law. From 1988-2001 he was an Adjunct Professor at the Georgetown University Law Center, where he taught Construction Contract Law. From 1996-1997 he was a member of the National Construction Arbitrator Training Faculty of the American Arbitration Association.
Judge Goodman also serves as a private arbitrator and mediator. He lectures frequently on alternative dispute resolution techniques, and is the author of Basic Skills for the New Arbitrator, 2d edition (Solomon Publications, 2004) and Basic Skills for the New Mediator, 2d edition (Solomon Publications, 2004). He is a graduate of the Georgetown University School of Foreign Service and the University of Toledo College of Law and a member of the Bars of Virginia, the District of Columbia, and Maryland.
